Working with Western Suburbs Electrical
TABLE OF CONTENTS
1. DEFINITIONS
This Agreement is between Western Suburbs Electrical ABN 81181269101 (referred to as “Western Suburbs Electrical”, “we”, “us”, “our”), and the customer described in the Quote referred to as “your name/company”, “you”, “your”, “Client”, and collectively the associated Parties for the work.
If you request the services set out in your Quote at the indicated Premises, you agree and accept that our Services are provided to you on these Terms and Conditions.
2. ACCEPTANCE OF QUOTE
You accept our Quote and Terms & Conditions by writing/verbally instructing us to proceed with the Quote Services, or by paying a deposit for the Services.
3. DEPOSIT TERMS & WITHHOLDING DEPOSIT CIRCUMSTANCES
Where you have engaged our services and have paid a deposit, you hereby acknowledge this deposit can become non-refundable. In order to help you avoid forgetting appointments or things going wrong regarding appointments, we attempt to double confirm appointments and times with you prior to traveling to you, however if we can’t make contact prior to traveling to site, we will likely cancel the appointment and attempt to reschedule without taking your deposit, depending on our discretion. If we can no longer make contact for a further week we reserve the right to cancel the job and withhold part/full deposit.
Once you have double confirmed the appointment on the day we reserve the right to withhold the complete/part of the deposit if one of the following circumstances happens thereafter:
-Appointment Cancellation Regardless of Reason.
-Failure to gain access during the appointment time frame given. For example, no one answers the door or responds to phone calls for 10 minutes.
-Late to appointment notifications: If you make contact to notify us of being late for an appointment's specified time frame, we reserve the right to cancel the appointment, although we will try to be lenient with this and fill in the time between if able.
-You have resolved an electrical issue yourself and/or our services are no longer required.
4. JOB TERMINATION
If the Client terminates the job prior to the completion of works, the Client must pay for all Services provided prior to termination, the amount of which will be decided by us.
5.FULL/PART PAYMENTS REQUIRED UPON JOB COMPLETION/PROGRESSION
FULL PAYMENT: For jobs other than through real estate, full payment is required immediately upon completion of works prior to us leaving site.
PART PAYMENT: Part payments will be required [Separate from deposit] upon part completion of a job prior to us leaving site if not all works are completed within the days visit, according to the amount of the work thus far completed. In addition a deposit amount will likely need to be added or carried forward for the following visit.
PAYMENT METHODS: Unless otherwise stated, we accept cash, PayID/bank account transfer [with screen shot proof] & 'in person' credit card methods of payment.
6. RETENTION OF TITLE
1. Ownership of all goods, parts, and materials (“Goods”) supplied by Western Suburbs Electrical (WSE) remains with WSE until full payment for those Goods and any associated labour/services has been received.
2. Until ownership passes to the Client:(a) The Client holds the Goods as a bailee for WSE and must keep the Goods in good condition.(b) WSE reserves the right to enter the Client’s premises (or any premises under the Client’s control where the Goods are stored or installed) at reasonable times to inspect or, if payment remains outstanding, to remove the Goods.(c) The Client must not sell, dispose of, or use the Goods in any way that is inconsistent with WSE’s ownership rights.
3. Risk in the Goods passes to the Client on delivery or installation, but title (ownership) does not pass until payment is received in full.
4. If the Goods are installed or affixed in such a way that they become part of a property and payment is not received, WSE reserves the right to remove the Goods or recover the value of those Goods as a debt. If Goods are removed, WSE is not responsible for reinstating any original items that were replaced or removed as part of the works.
7. DAMAGE
You acknowledge and agree that we are not responsible or liable for any damage to your Premises or property if the damage was:
-Unforeseeable;
-Beyond our control;
-Due to existing faults or damage; or
-Already warned about as a possibility
8.SAFETY REGARDING DANGEROUS SUBSTANCES OR CUSTOMERS
If at any time during the provision of the Services it is, in our discretion, unsafe to continue, we will suspend all Services until we are satisfied that the Services can be provided safely.
Aggressive Customers: In the event that our feelings of safety are compromised by threatening or aggressive clients we reserve the right to immediately leave the site. Additional personnel or the absence of the aggressive person will be required for continuing works.
Hazardous Substances: The Client acknowledges and agrees that, in the event asbestos or other toxic substances (Hazardous Substances) are discovered at the Premises, it is the responsibility of the Client to ensure safe removal of Hazardous Substances at its own cost. Under no circumstances will Western Suburbs Electrical handle the removal of any Hazardous Substances.
In the event that within a week we are unable to continue providing our Services due to the Premises still being unsafe, the Client is required to pay for the works thus far completed.
9. 5 YEAR WORKMANSHIP WARRANTY
Western Suburbs Electrical warrants that workmanship provided by us will be carried out with due care and skill.
Subject to the Australian Consumer Law, where a defect in our workmanship becomes apparent within five (5) years from the date the Services were provided, we will remedy the defect in accordance with our obligations under this Warranty and applicable law.
This Warranty does not cover defects or damage caused or partly caused by:

Failure by the Client to properly maintain the Materials;

Failure by the Client to follow any instructions or guidelines provided by us, our employees or contractors;

Use of the Materials other than for the application specified in the Quote;
-
Continued use of Materials after a defect becomes apparent, or ought reasonably to have become apparent;
-
Reasonable wear and tear;
-
Accidents, misuse or damage caused by the Client or any third party; or
-
Any alteration, repair or modification to our workmanship by another person without our prior consent.
Where a warranty claim is made, we may request photographs, videos or other information to assist in determining whether the issue appears to relate to our workmanship before attending the site.
Where site attendance is reasonably required to investigate an alleged workmanship defect, Western Suburbs Electrical may require a refundable inspection fee to be paid prior to attendance. The applicable inspection fee will be advised to the Client prior to the attendance.
The inspection fee will be refunded or credited in full where the inspection determines that the issue is attributable to a defect in our workmanship and is covered by this Warranty.
Where the inspection determines that the issue is not attributable to our workmanship, including where it is caused by a faulty or defective product, manufacturer fault, misuse, accidental damage, alteration, repair by others or another cause outside our responsibility, the inspection fee may be retained and applied towards applicable attendance, labour, testing or diagnostic charges.
Where reasonably practicable, we will attempt to determine the likely cause of the issue through photographs or other information provided by the Client prior to site attendance.
Nothing in this Warranty limits or excludes any rights or remedies available to the Client under the Australian Consumer Law.
10. MANUFACTURER'S WARRANTY
Where a product supplied by Western Suburbs Electrical becomes faulty due to a manufacturer's defect and is covered by the manufacturer's warranty, the manufacturer's warranty terms and conditions will apply.
Where applicable, Western Suburbs Electrical may assist the Client in liaising with the manufacturer or supplier regarding a warranty claim. Warranty administration, including correspondence, telephone calls, troubleshooting, submission of documentation, arranging inspections, following up warranty claims and other time spent dealing with the manufacturer or supplier, may be charged at our applicable labour or service rate.
Where a manufacturer or supplier provides a replacement product under warranty, labour associated with the removal, replacement or reinstallation of the product may be chargeable, unless the manufacturer, supplier or Western Suburbs Electrical agrees otherwise.
The cost of replacement materials covered by a valid manufacturer's warranty will not be charged to the Client where the manufacturer or supplier provides the replacement at no cost.
Manufacturer warranties are subject to the individual manufacturer's terms, conditions and warranty periods. The Client is responsible for registering any extended or promotional warranty where registration is required, unless otherwise agreed in writing.
Nothing in this section limits or excludes any rights or remedies available to the Client under the Australian Consumer Law.
11.SWITCHBOARD CHANGEOVERS
Where pre-existing electrical faults are identified during works (including but not limited to faulty appliances, damaged cables or fittings, or installation defects), the customer authorises up to the quote specified amount for fault-finding and minor materials at the labour rate specified per hour.
This authorisation allows investigation and rectification to proceed on site without delay where the owner or authorised representative may be unavailable. If additional time or works are required, the customer or authorised representative will be contacted to discuss findings and obtain further approval before proceeding.
Where further works are not authorised, any affected circuit(s) will remain isolated and de-energised until the fault has been rectified and the circuit can be safely returned to service.
12.WEATHER & SITE ACCESS
Western Suburbs Electrical reserves the right to postpone or reschedule any works requiring roof, ladder, scaffold, or other elevated access where rain, wind, or other weather conditions are deemed by the attending electrician to pose an unsafe risk to personal safety or work quality.
This assessment may be made in advance of the booking where the forecast indicates a likelihood of unsafe conditions, or closer to the time, including on the day, prior to travelling to site, or upon arrival, at the electrician's reasonable discretion.
Where a booking is postponed under this clause:
No cancellation or rescheduling fee will be charged to the client.
Western Suburbs Electrical will not be liable for any loss, inconvenience, or cost incurred by the client as a result of the postponement.
Any deposit paid is non-refundable and will carry over to the rescheduled date. If the client elects not to proceed with the rescheduled booking, the deposit is retained.
The client will be notified as soon as practicable, and a new date will be offered at the earliest suitable opportunity.
Where works have already commenced and must cease part-way due to weather, the client may be charged a part payment for the works completed thus far, payable before the electrician leaves site.
This clause applies regardless of any specific wind speed or rainfall measurement and is based on the on-site judgement of the licensed electrician performing the work.
13. DISCOUNTS & PROMOTIONS
First-Time Customer Discount (WSE-15):
To redeem, mention promo code WSE-15 after receiving your quote and before payment is made. This discount cannot be applied retroactively to invoices that have already been paid in full.
This offer is available to new customers only, on their first job booked with Western Suburbs Electrical.
The discount is 15% off labour costs (excluding GST), up to a maximum discount of $50.
Discount applies to labour only and does not apply to materials or after-hours emergency work.
This offer does not apply to real estate agencies or property management companies, who have a separate pricing deal in place. Contact us directly to discuss.
One redemption per customer/property.
Where additional work is added during the same visit, the discount (up to the $50 maximum) applies once to the total invoice, not separately to each job. This offer can only be claimed once.
Cannot be combined with any other offer, discount, or promotion.
This offer has no cash value and cannot be redeemed or exchanged for cash.
Western Suburbs Electrical reserves the right to amend or withdraw this offer at any time, without notice and at our sole discretion — including where we reasonably believe we have been provided with misleading or false information relevant to the offer's eligibility or application, even if the discount was previously confirmed as applying.

All matters not expressly covered by these terms are at the sole discretion of Western Suburbs Electrical
Seniors Discounts:
Seniors receive 15% off (up to $50) on their first visit, the same as our standard First-Time Customer Discount (WSE-15). From the second visit onward, seniors receive an ongoing 10% off labour, up to a maximum discount of $40, every visit.
Available to customers who hold a valid Seniors Card or Pensioner Concession Card. The cardholder must be present at the job and show their card at the time of service.
Applies only to the cardholder's own primary residence. Does not apply to investment properties, rental properties, or any property the cardholder does not personally live in.
Discount applies to labour only and does not apply to materials or after-hours emergency work.
Must be mentioned before payment is made. This discount cannot be applied retroactively to invoices that have already been paid in full.
Where additional work is added during the same visit, the discount (up to the applicable maximum) applies once to the total invoice, not separately to each job.

Real Estate Agencies Terms & Conditions
(Additional and Amended)
The general Terms and Conditions set out above apply equally to Real Estate Agencies, with the exception of the standard requirement for immediate payment upon completion of works. For Real Estate Agents, payment may instead be arranged to be deducted from the tenant's next rental payment, as set out below.
1. Payment Method
Where payment is to be made directly by the property owner (rather than deducted from the tenant's rent), this must be disclosed to Western Suburbs Electrical (WSE) prior to acceptance of the quote, along with agreement on our payment procedure, which may include a deposit.
If a property owner direct-payment arrangement has not been disclosed to us in advance, and payment is not received from the property owner within seven (7) days of invoicing, WSE reserves the right to deduct the outstanding amount from the tenant's next rental payment.
2. Payment Allocation
WSE reserves the right to apply any payment received from the Client toward any outstanding amount owed by the Client, regardless of how that payment was described or intended by the payer, including where it was designated for a specific job, deposit, or invoice.
3. Charges Arising from Tenant Conduct
WSE reserves the right to invoice the Agency a fee of $150 + GST in the circumstances set out below. As WSE's contractual relationship is with the Agency and not the tenant, this fee will be invoiced to the Agency, who will be responsible for recovering the amount from the tenant. Where possible, we will attempt to contact tenants prior to attending site to confirm availability and minimise the likelihood of these situations arising. WSE will not re-attend the property until the applicable fee has been paid, and reserves the right to decline to re-attend.
3.1 Issue resolved by tenant prior to attendance: Where a tenant resolves the electrical issue themselves while WSE is travelling to, or after arriving at, the property, such that our services are no longer required, resulting in lost time. The applicable fee will be invoiced to the Agency.
3.2 Tenant not present on arrival: Where a tenant does not answer the door and does not respond to a phone call attempt within 15 minutes of arrival, the appointment will be deemed cancelled and a cancellation fee will apply, to be invoiced to the Agency.
3.3 Late notice of tenant delay: Where a tenant contacts WSE (whether by phone or message), after our courtesy call or once WSE is already travelling to the appointment, to advise that they will be delayed and unable to be present within the scheduled appointment time frame, this will be treated as a failure by the tenant to meet the required appointment time frame, regardless of the length of the delay advised. In these circumstances, WSE is under no obligation to wait on site beyond a maximum of 15 minutes, and reserves the right to cancel the appointment and invoice the Agency the applicable fee. We will endeavour to exercise reasonable discretion where notice is given with sufficient time for us to adjust our schedule prior to departure.
3.4 Late cancellation by tenant: Cancellations must be made no later than the day prior to the scheduled appointment. Where a last-minute cancellation arises due to illness or emergency, WSE must be notified prior to our travelling to the appointment, or at the time of our courtesy call made prior to attendance. Where this notice period is not met, the applicable fee will be invoiced to the Agency.
